*In accordance with the EU's Digital Decade Principles, technological advancements and emerging data sharing contexts, such as the European Health Data Space (EHDS), are intended to be inclusive of all EU residents, thereby fostering their empowerment. In the context of health data sharing for secondary use, this paper explores the idea of individual empowerment in relation to the General Data Protection Regulation (GDPR). A comprehensive analysis of the concept of empowerment, in addition to the GDPR's conceptualisation of empowerment, reveals both positive procedural aspects for individuals and negative substantive empowerment. In this regard, the paper establishes a correlation between the concepts of empowerment and accountability, underscoring the significance of precise delineation of responsibilities. The paper then goes on to explore the EHDS Regulation's failure to address the ambiguity surrounding the delineation of responsibilities as set out in the GDPR, as well as the incompatibility of existing solutions proposed by legal scholars. The paper concludes with a hypothesis to explore in future research, with the aim of establishing a clear delineation of responsibilities, leading to empowerment in this novel context of data sharing.
